Earmarks destroy community.  Recall how the City of Dayton came together after the 1913 flood and financed and produced a system of dams that are still effective.  Congress shall pass no law nor provide funding for projects undertaken at the state or local level.

Federal control of the public schools has changed them from a jewel to an embarrassment.  The Federal Government  may usefully provide advice and information through an agency such as a Department of Education, but shall have no controlling role in the public schools. Control and funding of a public school shall be provided by the local community it serves.

The Sixteenth Amendment shall be repealed.  Necessary functions of Government shall be funded by a consumption tax.  Duties on imports and taxes on exports shall be proposed by The President of the United States and approved by the Congress. An individual’s income is a private matter and the government has no right to require disclosure of income or confiscate the fruits of an individual’s labor.   The Government shall have a right, in a criminal investigation, and under court order, to obtain information about an individual’s income and finances, however, such information shall remain confidential except after conviction of a crime involving such information. 

The Seventeenth Amendment of the Constitution shall be repealed. Senators should more closely serve the interests of the various states and be closely allied with the dominant political system in their own locale.

Because of the role of licensure in preventing entrepreneurial activity and restricting competition, the Government shall have no right to require licensure for any profession or legal form of commerce.  An appropriate government agency may make provably harmful or injurious commercial activities or services illegal, but all such laws must be subject to judicial review.

Frivolous lawsuits harm individuals.  In order to discourage such frivolous civil suits, as in the United Kingdom, the loser shall pay all costs of the lawsuit, including Federal, State, and local governments.  Class-action lawsuits shall be forbidden.

No laws shall be passed forbidding possibly harmful activities; laws should only provide redress of actual wrongs. Hypothetical harms such as global warming, ozone depletion and other such potential dangers shall not be used as a basis of regulation unless proven beyond a reasonable doubt in the judicial system and sanctioned for approval by the President.

No government body shall fund, tax, or regulate the press inclusive of radio, television, printed material, the internet, and any and all means involving the transfer of information. The government may enforce reasonable property rights to inherently limited means of transmission such as assigned radio frequencies, and shall limit any control to enforcement of accepted standards of decency over those means inherently open to the public. 

Federal regulation of commerce between the states shall be limited to assuring free and open commerce between the states of legal goods and services. In particular the federal government shall not construe its ability to regulate commerce between the states to mean the control of prices, production quotas, exploration limits, drilling rights, and all other functions individual to the states. 		<description>The FairTax: a Simple Solution

Our nation is in trouble.  We are awash in debt, and our overweening Federal Government seems to have little concern about putting our very economic survival in jeopardy.  Our system of taxation is directly responsible, along with the burdens of over-regulation, for sending thousands of businesses abroad; for steadily increasing the size of the underground economy; and for driving trillions of dollars (nearly $14 trillion at last count) into sheltering offshore financial centers.

The income tax is extremely wasteful (cost of compliance with the tax code is about $400 billion yearly,) and the ever-increasing burden of taxes harms people in many ways, not the least of which is by making it necessary for most families to entrust the care of their young children to others while both parents must work outside the home.  

The steeply progressive income tax, number two on Karl Marx&#039;s list of ten points that must be achieved in order to bring about a true communist society, has been used to redistribute wealth and incite class warfare.  We have almost reached the point at which more than half of Americans pay no direct Federal taxes and therefore have absolutely no incentive to call for limiting spending by the Government.  

Tax reform is, I believe, the single most effective and efficient means of addressing the economic crisis we face.  The FairTax is the star among the various forms of taxation that are discussed, because it is congruent with the pillars of the Tea Party/Liberty Group movement: limited government; fiscal restraint; free markets; and adherence to the Constitution.  

The FairTax, proposed legislation in the House (HB 25) and the Senate (SB 296) would require repeal of the 16th Amendment, abolishing the income tax, and institution instead of a national retail sales tax to meet the obligations of the Federal Government.  This legislation is the result of research, privately funded, by a number of top economists, tasked with finding a replacement for the income tax that would be revenue neutral.  At the outset, it was believed their research would conclude that a flat tax would serve best, however, it was found that a national retail sales tax of approximately 23% on all new goods and services was the best option.  

With the FairTax, there would be no more automatic withholding of Federal taxes.  All entitlements, including Social Security and Medicare/Medicaid would be funded by the FairTax.  The tax would be collected by the states, and a consumer would know exactly what was being paid, as the tax would be listed on the sales receipt.  Individuals would be in charge of how much Federal tax they paid, depending on their level of consumption and whether they purchased new or used goods.  

Included in the FairTax is a provision called the “prebate” which ensures that the poor are not liable for Federal taxes.  The “prebate” consists of a monthly credit equal to the amount of tax that would be paid on the essentials, up to the poverty level, that would be afforded each person with a Social Security number who applied for it.  Thus, the poor  would pay no Federal taxes, and everyone else would  control how much they paid in taxes above that level.  

Every earner would have more cash on hand with the end of withholding, and would have the opportunity to invest that money, improving his own financial picture and also the Nation&#039;s. 

There would be no more corporate taxes.  Therefore, prices of everything we buy would no longer be inflated by the addition of the corporate taxes of each contributor to the final product.  These “embedded taxes” amount to an average increase in final price of about 22%, and they not only impose a burden on our consumers, but also make our goods unattractive in world markets.  Because of the elimination of embedded taxes, the prices of goods and services would be roughly the same with the FairTax as they are without this sales tax.  

Without our punitive corporate taxes, lost industries would flock back to our shores.   Without the income tax, the $14 trillion secreted offshore could come home to our own economy.  The economy would grow, exports would grow, capital spending and productivity would increase, and personal income would correspondingly increase.  

Politicians would lose their major means of rewarding special interests and bolstering their own power and position when they could no longer manipulate the tax code.  An increase in the sales tax rate would require legislation, and there would likely be push back from the people.  The neverending growth of spending could at last be stalled.   Many politicians of course will resist losing the income tax as a tool to increase their power, but those of us who love liberty must be all for it.  Instead of the deceptiveness of the current system, taxation would be simple and transparent.   

Under the FairTax, those who participate in the underground economy would pay Federal taxes every time they go to the store or purchase a service.  Taxes would be collected from illegal aliens, and also from tourists.   

Perhaps our Founders could even stop spinning in their graves, were we to cease stealing the fruits of individuals&#039; labors in order to redistribute them, and were we to reward hard work and productivity, instead of punishing it.</description>

		<description>Another great essay.  What else strikes me (and should all Americans) is how quickly the Dems self proclaimed mandate collapsed as soon as they lost their super majority.  In other words, if their plan is so great, why does it have no hope of passing other than through tactics that attempt to squash debate and transparency.</description>

		<description>Recent polls are showing that Marco Rubio in FL is running ahead of RINO Charlie Crist (good) but Kirk in IL locked up that primary over several lackluster conservatives (bad). So it&#039;s not across the board. However, the same polls show that as of today, the GOP would take 5 senate seats and possibly 10; and regain control of the House. Just give Obama time, and he&#039;ll make it a clean sweep.</description>
